The Terms That Govern Your Use of ukwaterpark.org/

These terms explain what you can do with the site, what you cannot, the disclaimers and warranties that apply, the limit on our liability, and how disputes are resolved. Please read them — by using the site, you agree to them. Your statutory consumer rights under UK law are unaffected.

1. Editorial directory only. The site is not the HSE, not a venue operator, not a booking agent, not a tour operator.

2. Not for bookings or refunds. Use the venue’s own website for tickets, refunds and complaints.

3. Not for safety, medical or legal advice.

4. Verify with the venue before relying. Hours, prices and slide line-ups change frequently.

5. England and Wales law. Subject to the statutory rights of Scotland, Wales and Northern Ireland residents.

6. Statutory consumer rights preserved. Your rights under the Consumer Rights Act 2015 against the venue are not affected.

7. £100 liability cap. Aggregate liability is capped at £100, except for liability that cannot be excluded under UK law (including death or personal injury from negligence, fraud, etc.).

By accessing or using ukwaterpark.org/, you agree to these Terms of Use and to our Privacy Notice, Cookie Policy, Disclaimer, Copyright & IP Policy, Editorial Policy, Sources & Methodology, and Accessibility Statement. If you do not agree, please do not use the site.

2. Permitted Use

  • Read content for personal, informational or educational purposes
  • Print or save individual pages for personal reference
  • Share links to specific pages by URL
  • Quote brief extracts under sections 30 and 30A of the Copyright, Designs and Patents Act 1988 (fair dealing for the purpose of criticism, review, or quotation), with attribution to ukwaterpark.org/ and a link to the source page
  • Use venue contact details to contact the venue or attend in person
  • Use the site as a starting point to find which venue is in your area (verify with the venue itself before relying)

3. Prohibited Use

  • Use the site to misrepresent yourself as the HSE, PWTAG, RLSS UK, CIMSPA, the ASA, the CMA, the ICO, a local authority, or any specific venue or operator
  • Use the site to operate or promote an unauthorised ticket-resale service
  • Use the site to operate an unauthorised “package holiday” service outside the Package Travel and Linked Travel Arrangements Regulations 2018
  • Scrape, mass-download or systematically extract content for commercial republication or to build a competing database
  • Use the site to harass, threaten, dox or otherwise harm any individual, including any venue employee or operator staff
  • Republish content under a different brand without permission
  • Reverse-engineer, decompile or attempt to extract source code from any site infrastructure
  • Use the site to deliver malware, conduct attacks or otherwise interfere with site operation in breach of the Computer Misuse Act 1990
  • Use the site in any manner that breaches the Consumer Protection from Unfair Trading Regulations 2008, the CAP Code, the Defamation Act 2013, the Equality Act 2010, or any other applicable UK statute

4. Your UK Consumer Rights Position

Statutory rights under the Consumer Rights Act 2015 are not displaced by these Terms

Where you visit a UK water park, your contract is with the venue (or its parent operator). The Consumer Rights Act 2015 (CRA 2015) implies into that contract terms that the service will be performed with reasonable care and skill (section 49), within a reasonable time (section 52), and at a reasonable price (section 51); for goods, sections 9–17 imply terms about satisfactory quality, fit for purpose and as described. Statutory remedies for breach include repeat performance (section 55) and price reduction (section 56). ukwaterpark.org/ is not party to that contract. If a venue has failed to perform with reasonable care and skill, raise it with the venue first; if unresolved, seek help from Citizens Advice (0808 223 1133), local Trading Standards via Citizens Advice, the CMA at gov.uk/cma, the CAP Code via the ASA, or any CTSI-approved Alternative Dispute Resolution provider that the venue uses. For credit-card purchases between £100 and £30,000, consider section 75 of the Consumer Credit Act 1974.

5. Accounts

The site does not require account creation for normal browsing. If we add account features in the future, additional terms will apply. Any account would not be linked to any venue booking account in any way.

6. Intellectual Property

The original editorial content of ukwaterpark.org/ — directory entries, visit guides, framework summaries and design — is protected by copyright under the Copyright, Designs and Patents Act 1988 (CDPA 1988). Subject to the permitted-use clause above and to fair-dealing provisions under sections 29, 30 and 30A CDPA 1988, all rights reserved.

UK Crown Copyright material (e.g., HSE publications, Acts and Statutory Instruments) is reproduced under the Open Government Licence v3.0 where applicable, with attribution. We rely on the Open Government Licence terms when we summarise or extract such material.

We use the names of regulators, industry bodies, leisure-trust operators and venues nominatively — for example, “HSE”, “PWTAG”, “RLSS UK”, “CIMSPA”, “Everyone Active”, “GLL”, “Places Leisure”, “Center Parcs”, “Butlin's”, “Merlin Entertainments” and individual venue names — to identify the entity our entry covers. This is permitted descriptive use under section 11(2) of the Trade Marks Act 1994 (use of own name and of indications concerning the kind, quality and other characteristics of goods or services), and as honest concurrent use, where the use is not likely to cause confusion as to source, sponsorship or affiliation.

7. User Submissions

If you send us a correction, comment or suggestion, you grant us a perpetual, worldwide, royalty-free, non-exclusive licence to use, reproduce, modify and incorporate the submission into the site for editorial purposes. We will not publish your name or contact details without your permission.

8. Third-Party Content and Links

The site links extensively to the HSE, PWTAG, RLSS UK, CIMSPA, the ICO, the CMA, the ASA, leisure-trust operators, parent groups, individual venues, local authorities, Citizens Advice, Euan’s Guide, AccessAble and other third-party sites. We do not control those sites and are not responsible for their content, availability, accuracy or privacy practices. A link is not an endorsement.

9. Disclaimers

The site is provided “as is” and “as available”. To the fullest extent permitted by UK law, we exclude all warranties and conditions, express or implied (other than those that cannot be excluded under UK law), including any implied warranties of satisfactory quality, fitness for a particular purpose, and reasonable care and skill in respect of the site itself. We do not warrant that venue URLs, telephone numbers, opening hours, prices or facility line-ups are current at any specific moment — details change frequently, and the venue’s own page is the authoritative current reference.

10. Limitation of Liability

To the fullest extent permitted by UK law, ukwaterpark.org/ and its operators, editors, contributors, employees and agents are not liable for any indirect, consequential, special or incidental loss arising from your use of the site or your reliance on any content. Aggregate liability to any user is capped at one hundred pounds sterling (£100).

Nothing in these Terms limits or excludes any liability that cannot be limited or excluded under UK law, including:

  • liability for death or personal injury caused by our negligence (Unfair Contract Terms Act 1977, section 2; Consumer Rights Act 2015, section 65)
  • liability for fraud or fraudulent misrepresentation
  • liability under the Consumer Protection Act 1987 for defective products (where applicable)
  • any other liability that cannot be excluded or limited under English law or, where the user is resident there, the laws of Scotland, Wales or Northern Ireland

11. Indemnity

You agree to indemnify and hold harmless ukwaterpark.org/ and its operators, editors, contributors and agents from any claim, loss, liability, demand or expense (including reasonable legal costs) arising from your breach of these Terms or your misuse of the site, including any unauthorised commercial scraping, any misrepresentation as the HSE or another body, or any harassment of venue or operator staff.

12. Alternative Dispute Resolution (ADR) and Complaints

If you are unhappy with a venue’s service, the first step is to complain to the venue directly. If that does not resolve matters, the relevant routes include:

  • Citizens Advice consumer service — 0808 223 1133 (England, Wales) / 0808 164 6000 (Scotland) — the front door to UK consumer protection
  • Local Trading Standards — accessed via Citizens Advice; enforcement of the Consumer Protection from Unfair Trading Regulations 2008
  • Competition and Markets Authority (CMA) — for systemic consumer-protection concerns
  • Advertising Standards Authority (ASA) — for misleading advertising
  • CTSI-approved Alternative Dispute Resolution providers — for binding/non-binding ADR under the Alternative Dispute Resolution for Consumer Disputes (Competent Authorities and Information) Regulations 2015
  • The County Court (Sheriff Court in Scotland; County Court in Northern Ireland) — small claims for amounts up to the relevant track threshold
  • Section 75 Consumer Credit Act 1974 — joint-and-several liability of credit-card provider for purchases £100–£30,000

13. Term and Termination

These Terms are effective until terminated. We may terminate or suspend access to the site or any user, at any time, for any reason or no reason, without notice. Sections that by their nature should survive termination — including IP, disclaimers, liability cap, indemnity, ADR routes, governing law and miscellaneous — survive.

14. Governing Law and Jurisdiction

These Terms and any non-contractual obligations connected with them are governed by the laws of England and Wales. The courts of England and Wales have non-exclusive jurisdiction over any dispute. If you are a consumer resident in Scotland, you may bring proceedings in the Scottish courts and the law of Scotland may apply to certain matters. If you are a consumer resident in Northern Ireland, you may bring proceedings in the Northern Ireland courts and the law of Northern Ireland may apply. Mandatory consumer-protection provisions of the law of the country where you are habitually resident continue to apply.

15. Changes to These Terms

We may update these Terms. The “Last reviewed” date at the top reflects the current version. Material changes are flagged on the site for 30 days. Continued use after the effective date of changes constitutes acceptance.

16. Miscellaneous

  • Severability. If any clause is found unenforceable, the rest of the Terms remain in effect.
  • No waiver. Our failure to enforce any clause is not a waiver of future enforcement.
  • Entire agreement. These Terms, together with the Privacy Notice and the other policies incorporated by reference, constitute the entire agreement.
  • Assignment. You may not assign these Terms; we may assign them in connection with any sale, merger or reorganisation of the publication.
  • Third-party rights. Except as expressly stated, no third party has rights to enforce these Terms under the Contracts (Rights of Third Parties) Act 1999.
  • Headings. Section headings are for convenience only.
